Gina Carano’s lawsuit against Disney will go to trial next year after the company failed to get the lawsuit tossed out or stalled.

According to Deadline, the trial is set for September 29, 2025.

Disney previously filed a motion to dismiss the suit, which Gina Carano filed with funding from Elon Musk in February, but the motion was denied. They then attempted a stay of proceedings and interlocutory appeal.

U.S. District Judge Sherilyn Peace Garnett wrote in a decision this week, “Having considered the parties’ submissions, the relevant law, and the record in this case, the Court DENIES the Motion.”

Garnett previously ruled there was no need for oral argument on the appeal certification or the stay. The next step is discovery, meaning Disney will have to turn over documents related to the case.

Carano’s lawsuit regards her firing from Disney+ series “The Mandalorian,” in which she portrayed Cara Dune. Disney fired her after she made several controversial social media posts, including comparing being Republican in the modern U.S.A. to being Jewish during the Holocaust and mocking masking to prevent the spread of COVID-19. Carano is seeking damages and her job back.

Disney wrote in their motion to dismiss in April that “Carano’s decision to publicly trivialize the Holocaust by comparing criticism of political conservatives to the annihilation of millions of Jewish people — notably, not ‘thousands’ — was the final straw for Disney.”

They added that they have “a constitutional right not to associate its artistic expression with Carano’s speech, such that the First Amendment provides a complete defense to Carano’s claims.”

After the judge’s most recent decision, Carano wrote on X, “I am obviously very pleased with the opportunity to keep moving forward with the judicial process and into discovery. While I wish this was not necessary as it is not my desire to be in this battle in court, I will not shrink away from it because it is hard or uncomfortable.”
